By accessing or using our Website and the services offered, including but not limited to our diagnostic tools, treatment planners, drug information databases, and other automated systems (collectively, the “System”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to all of these Terms, you are prohibited from using the Website and System.
2. No Medical Advice; Disclaimer
THE WEVET SYSTEM IS AN INFORMATIONAL AND COMPUTATIONAL SUPPORT TOOL DESIGNED FOR QUALIFIED VETERINARY PROFESSIONALS. IT IS NOT A SUBSTITUTE FOR THE INDEPENDENT PROFESSIONAL JUDGMENT, DIAGNOSIS, OR TREATMENT PROVIDED BY A LICENSED VETERINARIAN.
The outputs generated by our System, including but not limited to differential diagnoses, treatment plans, and drug information, are based on automated processing of data and should be considered as suggestions only. The ultimate responsibility for any diagnosis, treatment decision, and patient outcome rests solely with the qualified veterinary professional using the System. You must exercise your own professional judgment and verify all information before applying it to any animal patient.
3. User Account and Eligibility
To access certain features, you must register for an account. You agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account. You must be a qualified veterinary professional, student, or researcher in the field of veterinary medicine to use the professional tools within the System. You are solely responsible for ensuring your use of the System complies with all applicable laws and professional standards in your jurisdiction.
4. Intellectual Property
The Website, System, and all content, features, and functionality thereof (including, but not limited to, text, graphics, logos, icons, images, data compilations, and the underlying software) are and will remain the exclusive property of WeVet and its licensors. These Terms do not grant you any intellectual property rights in the Website or System.
5. User-Generated Content
Our System may allow you to input data, text, and other information (“User Content”). You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and display that User Content solely for the purpose of providing and improving the System’s functionality. You represent and warrant that you own or have the necessary rights to the User Content you submit.
6. Third-Party Services and Content
The System may integrate with, or contain links to, third-party websites, services, or content (collectively, “Third-Party Services”). We do not endorse and are not responsible for the content, accuracy, or practices of these Third-Party Services. Your use of any Third-Party Service is at your own risk and subject to the terms and conditions of that third party.
7. Disclaimers and Limitation of Liability
THE WEBSITE AND SYSTEM ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WEVET EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL WEVET, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SYSTEM; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SYSTEM; (III) ANY CONTENT OBTAINED FROM THE SYSTEM; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
8. Indemnification
You agree to defend, indemnify, and hold harmless WeVet and its licensors from and against any claims, damages, obligations, losses, liabilities, costs, or debt (including attorney’s fees) arising from: (a) your use of and access to the System; (b) your violation of any term of these Terms; (c) your violation of any third-party right; or (d) any claim that your User Content caused damage to a third party or a patient.
9. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the System shall be subject to the exclusive jurisdiction of the courts located in Morbi, Gujarat, India.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of material changes by posting the new Terms on this page and updating the “Last Updated” date. Your continued use of the System after any such changes constitutes your acceptance of the new Terms.
11. Termination
We may terminate or suspend your account and bar access to the System immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.
